Last time we realized some interesting issues that are not apparent on the face of Title 18 USC 2257. The thing I love most about the law is that even with a short piece of code like 2257 I always learn something new when I delve into it. Today will be no different as we look at the proof of age requirements for nude models. Now keep in mind that the real purpose of Title 18 USC 2257 is to prosecute those despicable characters participating in exposing minors to pornography. I believe that anyone who does this should be locked up and castrated therefore I am a big proponent of this particular code.

Correspondingly there are several subsections of USC 2257 that go into great detail concerning the punishment for convicted offenders. They make for interesting reading and learning about the penalties should deter anyone from even considering it. The law states very clearly that two forms of ID are required to verify that a model is over 18, but it does not tell the producer exactly what type of ID must be collected. From USC 2257 you can read the following:

"Ascertain, by examination of an identification document containing such information, the performer's name and date of birth, and require the performer to provide such other indicia of his or her identity as may be prescribed by regulations."

Now what those regulations prescribed are not contained in the USC 2257 itself. We must look elsewhere in the code to find them and believe me they are buried in there deep. Sometimes I think that this is done intentionally so that the Feds can bust you because you failed to meet some obscure requirement that was missed only because it was so hard to find.

Before we continue I want you to remember that if the model looks young then that actor will be considered a minor unless you can produce documentation that proves otherwise. This on its face is troublesome to the producer. It actually gives the Feds the right to pursue said producer for any models that appear to look young based on someone believing that the model is a minor.

It is consistent in the code to place the onus of responsibility on the producer to remove any doubt. It is totally opposite of the premise "innocent until proven guilty" which is used in almost all cases that appear before a jury. In the content biz you are guilty until proven innocent so beware and be prepared.

Then what exactly is required when it comes to proof of age documentation? If you are furnished copies of a model's library card from a content provider then that content isn't worth the cyberspace it occupies. According the law a content provider must furnish 2 copies of ID and determine based on fair inspection that the Ids are legit.

If the IDs do not conform to the codes' guidelines then both the content provider and the web master who is considered the secondary producer can be in trouble. One picture ID issued by any state of our great union is usually good enough as long as that ID is in good form and contains verifiable watermarking. Two would be better but I can tell you how difficult it is to get models to show up with two forms of photo ID. Therefore, the second ID can be almost anything with the same name as that which appears on the picture ID as long as the first photo ID contains some watermarking as detailed below.

It is up to the producer to clearly examine the photo ID to ensure it is not fraudulent. Some fake Ids can be pretty good nowadays and there are girls out there who want to be in the biz but are just not old enough. With a 1200-dollar computer system and a few Photoshop lessons a high school kid can set up shop for his buddies so they can get into bars. It is not that difficult to do and it happens all the time.
